Bu Kullanım Koşulları ("Koşullar"), Lunify Nexo uygulamasını ("Hizmet") kullanımınızı düzenler. Hizmete kaydolarak veya Hizmeti kullanarak bu Koşulları kabul etmiş sayılırsınız. Koşulları kabul etmiyorsanız Hizmeti kullanmamalısınız.

1. Hizmetin tanımı

Lunify Nexo; müşteri ve aday kayıtlarının yönetimi, satış takibi, görev ve iş akışı yönetimi, e-posta ve takvim entegrasyonu gibi işlevler sunan web tabanlı bir müşteri ilişkileri yönetimi uygulamasıdır. Hizmet, isteğe bağlı olarak Google Workspace (Gmail, Takvim, Kişiler, Drive) ile entegre çalışabilir.

2. Hesap ve yetkilendirme

Hesap oluşturmak veya hesap tahsis edilmek için gerçek ve güncel bilgiler vermeniz gerekir.
Hesap bilgilerinizin ve şifrenizin gizliliğinden siz sorumlusunuz. Hesabınız üzerinden yapılan tüm işlemler size ait kabul edilir.
Yetkisiz bir erişimden şüphelenirseniz derhal bize bildirmelisiniz.
Hesabınızı üçüncü kişilerle paylaşamaz, devredemez veya kiralayamazsınız.

3. Kabul edilebilir kullanım

Hizmeti kullanırken aşağıdakileri yapmamayı kabul edersiniz:

Yürürlükteki mevzuata, üçüncü kişilerin haklarına veya bu Koşullara aykırı davranmak
İzinsiz ticari elektronik ileti (spam) göndermek veya yanıltıcı gönderici bilgisi kullanmak
Hizmete, sunuculara veya bağlı sistemlere yetkisiz erişmeye çalışmak, güvenlik önlemlerini aşmaya çalışmak
Hizmetin çalışmasını engelleyecek şekilde aşırı otomatik istek göndermek, tersine mühendislik yapmak veya kaynak kodunu izinsiz kopyalamak
Kötü amaçlı yazılım yüklemek veya dağıtmak
Sahibi olmadığınız ya da işlemek için hukuki dayanağınız bulunmayan kişisel verileri yüklemek

4. Verileriniz ve içeriğiniz

Hizmete yüklediğiniz tüm veriler ("Müşteri Verisi") size aittir. Bize yalnızca Hizmeti sunabilmemiz için gerekli olan sınırlı işleme yetkisini vermiş olursunuz. Müşteri Verisi'nin doğruluğu, hukuka uygunluğu ve gerekli izinlerin alınmış olmasından siz sorumlusunuz. Kişisel veri işlerken KVKK ve GDPR dâhil ilgili mevzuata uymayı kabul edersiniz.

5. Google Workspace entegrasyonu

Google hesabınızı bağlamak isteğe bağlıdır ve dilediğiniz zaman Ayarlar → Google Workspace → Bağlantıyı Kaldır ile veya Google hesap izinleri sayfasından iptal edilebilir.
Google hesabınızı bağladığınızda, Google'ın kendi hizmet şartları da geçerli olmaya devam eder.
Hizmet, Google API'lerinden aldığı verileri yalnızca sizin talep ettiğiniz işlevleri sağlamak için kullanır ve Google API Hizmetleri Kullanıcı Verileri Politikası'nın Sınırlı Kullanım gerekliliklerine uyar.
Google tarafındaki değişiklikler, kesintiler veya izin iptalleri nedeniyle entegrasyon işlevlerinin geçici olarak kullanılamamasından sorumlu değiliz.

6. Hizmet sürekliliği ve değişiklikler

Hizmeti kesintisiz sunmak için makul çaba gösteririz; ancak bakım, güncelleme, altyapı arızası veya mücbir sebep hâllerinde geçici kesintiler yaşanabilir. Hizmetin işlevlerini geliştirmek, değiştirmek veya kullanımdan kaldırmak hakkımız saklıdır. Önemli değişiklikler makul bir süre önce duyurulur.

7. Fikri mülkiyet

Hizmetin yazılımı, arayüzü, tasarımı, markası ve tüm bileşenlerine ilişkin fikri mülkiyet hakları Lunify Nexo'e veya lisans verenlerine aittir. Bu Koşullar size Hizmeti kullanma hakkı dışında herhangi bir hak devretmez.

8. Sorumluluğun sınırlandırılması

Hizmet, yürürlükteki mevzuatın izin verdiği ölçüde "olduğu gibi" sunulur. Dolaylı zararlar, kâr kaybı, veri kaybı veya iş kesintisinden doğan zararlardan sorumlu tutulamayız. Her hâlükârda toplam sorumluluğumuz, talebin doğduğu tarihten önceki on iki (12) ay içinde Hizmet için ödediğiniz tutarla sınırlıdır. Bu sınırlama, kasıt veya ağır ihmalden doğan sorumluluk ile mevzuat gereği sınırlandırılamayan sorumluluk hâllerini kapsamaz.

9. Askıya alma ve fesih

Bu Koşulları ihlal etmeniz veya Hizmetin ya da diğer kullanıcıların güvenliğini riske atmanız hâlinde hesabınızı askıya alabilir veya kapatabiliriz. Siz de dilediğiniz zaman hesabınızın kapatılmasını talep ederek Hizmeti kullanmayı bırakabilirsiniz. Fesih hâlinde verilerinizin silinmesi Gizlilik Politikası'ndaki esaslara göre yapılır.

10. Uygulanacak hukuk

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul mahkemeleri yetkilidir.

11. Koşullarda değişiklik

Bu Koşullar zaman zaman güncellenebilir. Güncel metin her zaman bu sayfada yayınlanır ve "son güncelleme" tarihi değiştirilir. Değişiklikten sonra Hizmeti kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.

These Terms of Service ("Terms") govern your use of the Lunify Nexo application (the "Service"). By registering for or using the Service you agree to these Terms. If you do not agree, you must not use the Service.

1. The Service

Lunify Nexo is a web-based customer relationship management application providing customer and lead management, sales tracking, task and workflow management, and email and calendar integration. The Service can optionally integrate with Google Workspace (Gmail, Calendar, Contacts, Drive).

2. Accounts and authorisation

You must provide accurate, current information when creating or being assigned an account.
You are responsible for keeping your credentials confidential. All activity carried out through your account is deemed to be yours.
You must notify us immediately if you suspect unauthorised access.
You may not share, transfer or resell your account.

3. Acceptable use

When using the Service, you agree not to:

Violate applicable law, third-party rights, or these Terms
Send unsolicited commercial messages (spam) or use misleading sender information
Attempt to gain unauthorised access to the Service, its servers or related systems, or circumvent security controls
Send excessive automated requests, reverse engineer the Service, or copy its source code without permission
Upload or distribute malicious software
Upload personal data you do not own or have no lawful basis to process

4. Your data and content

All data you upload to the Service ("Customer Data") remains yours. You grant us only the limited processing rights necessary to operate and provide the Service. You are responsible for the accuracy and lawfulness of Customer Data and for obtaining any required consents. You agree to comply with applicable data protection law, including GDPR and Turkish KVKK.

How we process data is described in our Privacy Policy and on the Google User Data Usage page.

5. Google Workspace integration

Connecting a Google Account is optional and can be revoked at any time via Settings → Google Workspace → Disconnect or from your Google account permissions.
When you connect a Google Account, Google's own terms continue to apply to your use of Google services.
The Service uses data received from Google APIs solely to provide the features you request, in compliance with the Limited Use requirements of the Google API Services User Data Policy.
We are not liable for integration features becoming temporarily unavailable due to changes, outages or permission revocations on Google's side.

6. Availability and changes

We use reasonable efforts to keep the Service available, but temporary interruptions may occur due to maintenance, updates, infrastructure failures or force majeure. We reserve the right to improve, modify or discontinue features. Material changes will be announced with reasonable notice.

7. Intellectual property

All intellectual property rights in the Service's software, interface, design and brand belong to Lunify Nexo or its licensors. These Terms grant you no rights other than the right to use the Service.

8. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is". We are not liable for indirect damages, lost profits, lost data or business interruption. In any event, our total aggregate liability is limited to the amounts you paid for the Service in the twelve (12) months preceding the claim. This limitation does not apply to liability arising from wilful misconduct or gross negligence, or to liability that cannot be limited by law.

9. Suspension and termination

We may suspend or close your account if you breach these Terms or put the Service or other users at risk. You may stop using the Service at any time by requesting account closure. On termination, deletion of your data follows the principles in the Privacy Policy.

10. Governing law

These Terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction over any dispute.

11. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with a revised "last updated" date. Continuing to use the Service after a change means you accept the updated Terms.
